You have made the decision to update or obtain a will for the first time, but where to go to get a will?
We might be biased, but we think you should come and see us, and here’s a few reasons why.
Whether or not a will is valid in NSW is determined by the rules set out in the Succession Act 2006. The Act outlines the legal requirements for signing and witnessing wills along with other points which may impact on your will, such as what happens when you marry or divorce after the will is made. Unless you have a working knowledge of these rules there is a danger that your ‘do-it-yourself’ will purchased with your lotto ticket at the local newsagent will do you more harm than good.
Along with knowing the formal requirements for making a will, a DIY will does not have the flexibility of incorporating your personal circumstances. What happens if one of your children beneficiaries predeceased you? Should your grandchildren take a share of your estate in those circumstances, and what will your will say about the age those beneficiaries take? Trying to draft suitable clauses to meet your circumstances is a difficult task, because you’re not a wills lawyer!
Putting off making a will, or trying to draft a will without legal assistance means that you risk dying without having a legally binding and valid will. Die without a legally valid will and the Succession Act will determine who receives your estate upon your death – and that might not be the person(s) you want. Take control of who gets your estate by ensuring your will is valid and up to date by seeing a solicitor.
Most wills prepared by Prime Lawyers are neither complex, time consuming or expensive. Drafting a will is a straightforward process for our wills lawyers so we are able to set low fixed will drafting costs. Our costs are also reduced for couples in need of mirror wills (wills which mirror the terms of each other). The peace of mind in having a legally drafted and valid will is worth the small cost of trading up from a DIY version to a Prime Lawyers made will.
Our lawyers will helpfully advise you on aspects of your will which you did not know or consider but ought to. What happens to superannuation, property owned as joint tenants, and the guardianship of your minor children? Come in and see us and we’ll explain all (remember, we know wills). We can also draft estate planning documents such as Powers of Attorney and the Appointments of Enduring Guardians.
We have conveniently located offices throughout Sydney so there is a good chance that we have an office close to where you live, work or play. Our wills lawyers work out of the Sydney CBD, Chatswood, Parramatta, Sutherland and Wollongong and along with face to face meetings we can also take preliminary instructions via the telephone or by email.
Make today the day you make an appointment to update or make a new will by getting in touch with our team by calling your local Prime Lawyers office or by making an online enquiry to find out our will drafting costs.
