How much does Probate cost?

There are two groups of costs associated with obtaining the Grant of Probate.

The first is the costs which are associated with the application itself, namely the Online Court notices ($47.00) and Supreme Court filing fee.

The Supreme Court filing fee is calculated according to the gross value of the assets located within NSW. For the purpose of the filing fee the liabilities of the estate are disregarded. The current fee schedule can be found here.

The second group of costs are the professional fees paid to advisors during the course of the Probate application and administration. Those advisors should include an accountant and of course a lawyer.

A lawyer’s fees for obtaining the Grant of Probate are regulated by the provisions of the Legal Profession Uniform Law Application Regulation 2015. The regulation prohibits lawyers from charging above a certain amount, again with reference to the gross value of the estate.

Our Probate Division does not calculate the legal fees for obtaining the Grant of Probate according simply to the gross value of the estate. Instead legal fees are calculated according to a number of variables, including the complexity of the estate. By doing so we ensure that in most instances, especially for simply estates, the costs charged to obtain the Grant of Probate are less than the scale set out in the Legal Profession Uniform Law Application Regulation 2015 (and never more).
